Introduction to the User Agreement:
Etoiles Store welcomes you and informs you that you will find below the terms and conditions regulating your use of this store and all legal effects resulting from your use of the store's services over the network via this electronic platform. Any person's use of the store, whether as a consumer of a service or a product of the store or otherwise, constitutes their approval and acceptance, while in full legal capacity as recognized by Sharia, regulations, and law, of all articles and provisions of this agreement. It is a confirmation of your commitment to its regulations and what is stated therein. This agreement applies to all types of dealings between the consumer and the store. This agreement is considered valid and effective once you agree to it and begin registering in the store under Article 10 of the Saudi Electronic Transactions Law.
Article 1 - Introduction and Definitions:
The above preamble is considered an integral part of this agreement. Below are the meanings and definitions of the main terms used in this agreement:
(The Store): This definition includes all forms of the store on the network, whether it is an electronic application or a website.
(The Consumer): The person who engages in electronic commerce desiring to obtain the products or services provided by the store through its electronic platform.
(The Agreement): This term refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.
Article 2 - Legal Capacity of the Consumer:
The consumer acknowledges that they have the legal capacity recognized by Sharia and regulations to deal with the store, or that they are at least eighteen years of age.
The consumer agrees that in the event of violating this article, they shall bear the consequences of such violation toward third parties.
Article 3 - Nature of Obligation:
The store's obligation toward consumers is to provide the (service or product).
The store may provide other services such as after-sales services or other related services, depending on the nature and type of (service or product) requested by the consumer.
Article 4 - Controls of Use:
The consumer is committed to using the store's electronic platform in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.
When purchasing a service or product from this store, the consumer is committed not to use this service or product in violation of public morals and the regulations in force in the Kingdom of Saudi Arabia.
Article 5 - Accounts and Registration Obligations:
Immediately upon applying for membership in this store as a user, you are obligated to disclose specific information and choose a username and a secret password to be used for the store's services. By doing so, you have agreed to:
Being responsible for maintaining the confidentiality of your account information and password, and thereby agreeing to immediately notify this store of any unauthorized use of your account information or any other breach of your confidential information.
The store shall not, under any circumstances, be responsible for any loss that may occur to you, directly or indirectly, morally or materially, as a result of revealing the username or login password information.
You are committed to using your account or membership with the store yourself, as you are fully responsible for it. If someone else uses it, this is a presumption that you have authorized them to use the store in your name and for your account.
You are committed to using the store with all seriousness and credibility.
You are committed to disclosing true, correct, updated, complete, and legal information about yourself as required during registration with the store, and you are committed to updating your data if it changes in reality or if the need arises.
Our store is committed to treating your personal information and contact addresses with strict confidentiality.
If it becomes clear to the store that you have disclosed information that is untrue, incorrect, not current, incomplete, illegal, or contrary to what was stated in the user agreement, the store has the right to stop, freeze, or cancel your membership, or your store and account on the platform, without prejudice to the store's other rights and legitimate means to recover its rights and protect other consumers.
In the event of non-compliance with any of the above, the store management has the right to suspend or cancel your store or membership, or block you from the store.
Article 6 - Electronic Communications and Official Means of Communication:
The parties to this agreement agree that communication is carried out via the mobile number or email registered on the platform.
The consumer agrees that all agreements, advertisements, statements, and other communications provided electronically take the place of their written counterparts and are a standing argument in themselves in meeting legal and Sharia requirements.
The consumer agrees to the possibility of communicating with them and notifying them of any provisions regarding this agreement or regarding dealings with them through the store management broadcasting general messages to all consumers or to specific users of the store.
Article 7 - Amendments to the User Agreement and Fees:
In the event of the cancellation of any article or clause contained in this agreement, or if any article or clause is no longer effective, such a matter does not cancel the validity of the remaining articles, clauses, rules, and provisions contained in this agreement, and they remain in effect until further notice from the store management.
This agreement—which is amended from time to time as the case may require—constitutes the mechanism of work, understanding, and agreement between the (Consumer) and (The Store).
The store may impose fees on some consumers depending on the offers, products, or services they request, or what the state imposes in fees or taxes on the nature of the product or service.
The store reserves the right to add, increase, reduce, or discount any fees or expenses under the articles, clauses, and provisions of the user agreement for any of the consumers, regardless of the reason for their registration.
Article 8 - Payment and Settlement Services:
Through its partners, the store provides a payment and settlement system. This can be done entirely online through the payment options available on the store or through any payment method provided by the store from time to time.
The store is committed to determining the price of the service or product it displays in its store according to the recognized market value.
The store is committed to providing invoices and receipts for all amounts and profits arising in its store and is committed to giving the consumer an invoice for their purchase of a service or product.
The store is committed to providing the recognized accounting specifications in its online store, in application of the provisions of this agreement and for the legal, economic, commercial, and organizational interests in this regulation.
Article 9 - Intellectual Property:
The intellectual property rights of the store are rights fully owned by the store, whether they were owned before or after the establishment of this electronic platform.
The consumer respects the intellectual property rights of the store, which include the name of the store itself, words, logos, and other symbols belonging to the store or displayed on it, as every right associated with the store's name is the full intellectual property of the store.
This user agreement is governed and drafted according to the laws, regulations, and legislation in force and applicable in the Kingdom of Saudi Arabia and is fully and completely subject to the regulations in force with the authorities in the Kingdom of Saudi Arabia.
In the event of the cancellation of any article or clause in this user agreement, or if any article or clause is no longer effective, such a matter does not cancel the validity of the remaining articles, clauses, and provisions contained in the user agreement and they remain in effect until further notice from the store management. This user agreement—which may be amended from time to time as the case may require—constitutes the user agreement and the mechanism of work, understanding, agreement, and contracting between the store and the consumer.
